The product
Simple Stack is a one-time digital download you configure and deploy yourself. These terms form the agreement between you and Flavr Web Dev Ltd.
Your licence
One licence covers one named person or legal entity, including its employees and contractors working for it. On payment you receive a non-exclusive, worldwide, perpetual licence to use, modify and deploy Simple Stack for unlimited own and client projects, including commercial ones. You may give a client a finished, deployed product; a client who needs an independent copy of the reusable starter source needs their own licence unless we agree otherwise in writing.
What you may not do
- Resell, redistribute, sublicense, republish or give away the reusable starter itself (in whole or substantial part), including as a competing starter, kit, template or standalone source-code product.
- Share your download, account or access links outside the licensed person or entity.
Delivery & payment
Your download is delivered to your account immediately after payment, via a sign-in link sent to your email. Prices are shown at checkout and processed by Stripe. Prices may change; you pay the price shown when you buy.
Updates and support
We intend to maintain and refine Simple Stack and may release updates, but future releases, support response times and continued hosted availability are not part of the purchase unless we expressly say otherwise. Your licence is for the version you download. This does not affect our obligation to supply digital content that conforms to the contract when delivered.
Security and your deployment
No software can be guaranteed free from every defect or security vulnerability. You are responsible for reviewing, configuring, testing, securing and maintaining your deployment, credentials, hosting and third-party services. We are not responsible for problems caused by your modifications, configuration, hosting providers or failure to follow the supplied documentation.
Liability
Nothing in these terms limits your statutory consumer rights or excludes liability where the law does not permit it, including liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or our liability for digital content that is not of satisfactory quality, fit for purpose or as described.
If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach or failure to use reasonable care and skill, but not business losses. If you buy wholly for business purposes, then, subject to the exclusions above, we are not liable for indirect or consequential loss, loss of profit, revenue, data or business interruption, and our aggregate liability is limited to the amount you paid for Simple Stack.
Your cancellation rights
This is digital content supplied immediately after payment. If you buy as a consumer, at Checkout you expressly request supply during the 14-day cancellation period and acknowledge that you lose the change-of-mind right to cancel once supply begins. This is separate from your statutory rights where digital content is faulty, not as described, unfit for a purpose made known to us, or we do not have the right to supply it. Contact us and we will provide repair, replacement, a price reduction or a refund where the law requires.
Governing law
These terms are governed by the law of England and Wales. If you are a consumer, you keep any mandatory protections provided by the law where you live and may bring proceedings in your local courts. If you buy wholly for business purposes, the courts of England and Wales have exclusive jurisdiction. Questions or complaints: support@flavrapps.com.
